A leading Japanese company with a global footprint, renowned for their innovation in the chemical and food product sectors, approached us due to our strong track record in successful opposition work for Japanese companies in this industry. We represented them in an offensive opposition against a major competitor’s European patent.
We collaborated closely with the company’s technical team to gain a comprehensive understanding of the relevant technology. This allowed us to identify and exploit critical weaknesses in the competitor’s patent. Notably, we succeeded in our lack of sufficiency attack, a rare and challenging ground to win, particularly in this technical field. Our success was based on our in depth knowledge and analysis of the patent's data.
This was a significant commercial victory for our client. Recognising the high commercial stakes, the proprietor filed a petition for review, in a last attempt to salvage some patent protection for this crucial product. The petition was rejected marking a final end to the process.
Our successful opposition not only highlights our expertise in patent law and strategic opposition but also significantly strengthens our clients market position in Europe. This case exemplifies the critical importance of detailed technical understanding and strategic legal action in highly competitive fields.”
