Background
Ben has a Master’s degree in Intellectual Property Law from the University of Melbourne. He also holds a Bachelor of Engineering (Mechanical) and Bachelor of Commerce (Finance) from the University of Queensland.
Ben started his career at a large top-tier Australian IP firm in 2012, qualifying as an Australian and New Zealand Patent Attorney in 2014. He then joined Mewburn Ellis in 2018, qualifying as a Chartered Patent Attorney in 2021 and a European Patent Attorney in 2022.
Opposition highlights
Ben has worked on a number of opposition cases, including:
EP2808678B1 – Defensive opposition of a patent owned by Heineken UK in relation to a beverage dispense system. The prior art filed by the opponent included evidence of prior use. The patent was maintained as amended.
EP3651591B1 - An offensive opposition of a patent owned by Essentra Filter Products in relation to a filter for a smoking article. The patent was revoked in its entirety after oral proceedings.
EP2765424B1 - Defensive opposition of a patent owned by Hitachi High Tech Corporation in relation to a method for analysing biomolecules. Ben filed a reply to the opposition, resulting in a preliminary opinion of the Opposition Division that was entirely positive for the patentee. The opposition was withdrawn prior to oral proceedings.
