Jan Rether

Jan is a German lawyer and a member of the trade mark team with 13 years of experience in relation to trade mark and related copyright and design matters. He provides advice with regard to general strategy, clearances, filing and prosecution as well as enforcement of trade marks in opposition and court proceedings. He is based in the firm’s Munich office and joined the partnership at Mewburn Ellis in 2022.

• Trade mark prosecution, including management of worldwide trademark portfolios
• Trade mark oppositions and cancellation actions, up to the General Court of the European Union and the European Court of  Justice respectively the Federal German Patent Court
• Trade mark enforcement, including litigation before German infringement courts

He regularly acts in negotiating agreements, including delimitation agreements and out of court settlements, managing Border Seizure Applications, as well as design and copyright matters.

Jan has inter alia worked with large IT and telecommunication device companies, internet and social media companies and major German telecommunication devices manufacturers as well as international supermarket chains. He has also worked with European SME’s, several luxury fashions companies, manufacturers in the automotive industry, along with Fintech companies and certifying companies (advising on and prosecuting European Union Certification Marks). 

Background

For many years, Jan has been giving seminars and speeches on various trademark topics inter alia for different training institutes for trademark professionals as well as at trademark conferences. He is an active member of INTA currently acting in a leadership role in one of the INTA Committees. He regularly attends INTA meetings (Annual Meeting and Leadership Meeting) as well as the Marques Annual Conference. He is also a member of the German IP organization GRUR.
